In consideration of the mutual promises contained herein, the parties hereto agree as follows:
- I hereby agree to breed Thoroughbred mare, ____________________________to theThoroughbred Stallion,_____________________________, standing at Taylor Mountain Farm, Charles Town, WV for the 2006 breeding season. The fee payable shall be the sum of $____________________which is payable when the foal stands and nurses.
- Mare owner agrees that the Mare to be bred is healthy and in sound breeding condition. This fact is to be certified by a qualified veterinarian before the mare is bred. The mare owner has sole responsibility of presenting the correct Mare to the Stallion.
- This contract shall not be assigned or transferred by the Mare owner. In the event that the Mare is sold or enters a public auction ring for the purpose of sale, the fee, if unpaid, shall be immediately due and payable to the Stallion owner, and shall not be refundable under any circumstances.
- It is further agreed that if the Stallion should die, be sold by the owner or become unfit for service before serving the Mare, or if the Mare dies or becomes unfit to be bred and is so certified by a veterinary certificate upon request, then this Contract is and shall be null and void.
- Neither the Stallion owner, Stallion Manager nor Taylor Mountain Farm, LLC shall be responsible for any disease, accident or injury to the Mare.
- In the event that the Mare delivers twins the Mare owner has the following options: (a) Registering the foals and a Stallion fee will be due and payable when the foals stand and nurse, or (b) Mare owner chooses not to register the foals and no Stallion fee will be due.
- This contract shall be binding upon the parties, their heirs, personal representatives and successors. Both parties acknowledge that this Contract shall be executed and binding.
